A Supreme Question

The founders and the framers continue to demonstrate their insight into the creation of their experiment in self-government and the rules by which the nation would function.

They created three equal branches of the United States government - the Executive, the Legislative, and the Judiciary. Their plan worked along the lines that if the executive – the President, or Legislative – the Congress, tried to pull a political power coup, the Judiciary – the Supreme Court – would be the deciding vote  and referee in all governmental branch disputes.

Until the last decade or so, the structure worked as intended. The political left has been trying to pervert the process in far too many ways as of late.

To wit:

When the left tries to pull a constitutional fast one, they seem confident that the liberal justices are rubber stamp votes for creating legislation from the bench, in violation of the Constitution. The corrupt media then begin the onslaught of wondering which of the conservative jurists will exhibit ‘bravery’ and vote with the liberals.

We find it amusing and terrifying that there is never a question of any liberal jurist demonstrating similar bravery and voting with the conservatives. Among the political idio-crats, bravery only works one way.

The Constitution provides for a lifetime appointment. This has had the occasional series of complaints throughout our history, but nothing of consequence.

In the last few years, the imbeciles of the political extreme left, in the face of Supreme Court losses, have not only demanded term limits for jurists, but to pack the court with a sufficient number of liberal jurists to overcome the current conservative majority.

They apparently no longer believe in bravery and have decided to instead count on strength in numbers. We have written previously how in the ruling on Covid mandates, each of the three liberal Supreme Court judges got major facts on the case wildly wrong, and instead voted along political policy lines. In the scheme to subvert the Constitution, they are attempting to impune the historical impartiality og the Court, trying to create it in their own warped image.

America deserves better than a funhouse mirror image of justice.

This week, Judge Ketanji Brown Jackson will begin her Senate confirmation hearings. Some have attempted to claim she would be the most significant apppointment since John Marshall. Other will claim she must not be allowed in traffic court, let alone the highest court in the land.

We will not engage in such political sport.

Joe Biden has already diminished her by stating he would appoint a woman of color to the bench. No matter her qualifications, she will be forever tarnished with the epithet she was picked solely for her gender and skin pigment attributes.

The Madison Conservative will ignore all of the political noise and focus on a single question, which we believe, would set the predicate for the rest of her hearing.

A single interrogative that to our knowledge has never been asked of a Supreme Court nominee.

The Supreme Court decides issues of constitutionality, if any law or act is allowed under our founding document.

We have our own opinions on the answer, but will wait until after the hearings to discuss it in this forum.

We would ask our readers to consider the question, decide their answer, and see if their elected representative gets with a country mile of asking it for the constituents.

“Madame Justice,

You will be deciding issues relative to the United Stses Constitution.

 

In your legal opinion, to whom does the Constitution apply? Do its rights extend to people who broke our laws to enter the country? There are numerous issues affecting this country. Who do you see having a legitimate claim to the rights and responsibilities of the Constitution?”

 

We would be fascinated with her response.

The Face Of Cowardice

PLEASE NOTE: What follows is commentary of those in elected office. It is not intended to reflect on any population, save those who hold seats of authority. We ask your indulgence for this particular post. For us, in many ways, this is personal.

 

Axioms are such because they have been proven true.

One of the strongest, and saddest, is this:

They came for those people, and I said nothing. They came for other groups of people, and still I remained silent.

Finally they came for me, and there was no one left to protest my disappearance.

 

Ukraine is under assault by this generations Adolf Hitler.

The world sits by and does nothing.

The United States Congress passed a resolution in support of Ukraine. The paper it was printed on was insufficiently strong enough to stop the Russian missile onslaught.

The United Nations, ostensibly the deliberative body where countries could meet and resolve their differences peaceably had difficulty garnering unanimous support for even a declaration condemning Russia.

The leaders of NATO are standing by watching war crimes being committed and do nothing more than searching for a camera crew so they can lament the situation.

The “free world” should be disgusted and ashamed of themselves.

Joe Biden, coward-in-chief, was asked about the evidence of Putin’s war crimes and responded with the terse “we’re monitoring it.” Hey Joe, how many women need to be slaughtered and children butchered before you decide you’ve done enough checking in on things?

Consider this.

President Donald J. Trump was told of Syria using chemical weapons on its own people, in violation of international law.

Trump’s reaction was pure America.

He dropped the MOAB (Mother of all bombs) on a Syrian military facility.

Syria has mostly been behaving themselves ever since.

New reports comment on the Ukrainian use of anti-tank and Javelin misses to defend themselves.

Nobody ever notes where those weapons came from.

President Trump again. He commented at the time of the sale that it was a calculated risk, but that Ukraine had to be able to defend itself.

Biden, Pelosi, Schumer and the rest of the Russian hoax conspirators condemned the action at the time as a sign of Trumps ignorance and subservience to the corrupt Ukraine government.

They have all opted to remain silent on those facts, instead passing resolutions of support.

The only leader of consequence is Volodymyr Zelenskyi, the President of Ukraine.

When Joe Biden, in sadly characteristic fashion, offered the Ukrainian leader safe passage out of the country, the response was positively Churchillian – “I don’t need a ride, I need ammo!”. Lost in much of the coverage is that there has been no government request for troops to be sent to Ukraine, only weaponry. In other words, nobody is being asked to fight for Ukraine, just get them the weapons and they’ll do their own fighting.

The circle of fellow cowards surrounding Biden claim they were not taken by surprise by Putin’s actions. If true, why in God’s name did they not follow Trump’s lead and stockpile weapons ahead of time? Any outraged political leader care to offer an answer?

The “civilized world” seems to be under the control of a psychopath. “Oh, don’t upset Vlad, he’ll use his nukes.”

The reality is that there is no such thing as a limited nuclear war. One nuclear weapon goes off, what happens next is called mutually assured destruction. We are not advocating war, but history has proven that the two most successful leaders America has had in dealing with Russia – Reagan & Trump - understood the basic axiom of avoiding war:

“Peace Through Strength”.

Today’s political leaders have a simple choice – repeat the mistakes of Neville Chamberlain or follow the path of Reagan –“Mr. Gorbachev, tear down this wall!.”

It really is that simple.

If the people of the world do not act, Putin surely will.

The State of the Union Speech - 3/1/22 - A Madison Conservative Commentary

In our attempts to find a way to describe President Biden’s first State of the Union address, the one word that we keep returning to is ‘whiplash’.

There are those who will find the speech tedious and uninspired. Others will want to focus on the provable lies Biden spewed in feeble attempts to justify his ineptitude.

We found ourselves commenting out-loud with the phrase of “what?”

Analyzing and dismantling the speech line by line could fill volumes and be an unfair use of your time.

We will attempt to convey our point by focusing on several significant issues.

We understand that SOTU speeches are mostly forgettable and tend to devolve into a  ‘wish-list’ of priorities for the administration in the coming legislative year.

Biden went way beyond that and must be held to account.

To wit:

 

UKRAINE.

Biden attempted to assert that he had spent his time building allied coalitions in support of Ukraine. Given his cowardice in Afghanistan, it is particularly galling to hear Biden try to take credit for uniting NATO. It was President Trump who challenged the need for NATO, demanding that member nations fulfill their financial responsibilities to the organization. It was Trump who assured that Biden had a funded NATO that could provide support for Ukraine. At the time, Biden accused Trump of being rude and ignorant of our allies. He promise to return America to full stature on the world stage. Biden then abandoned those very same allies in his exit from Afghanistan. It was European nations that began instituting sanctions on Russia. Biden omitted in his speech that the American sanctions excluded Russia’s energy supplies. On one hand, Biden claims to be the cause for unity against Russia. With the other hand, he refuses to stop buying Russian energy. The leader of the free world is funding the invasion of Ukraine.

That fact somehow was omitted from his speech, leaving people around the world to question if Biden is for or against Russia.

 

INFLATION & THE ECONOMY

The political left demanded the imbecilic spending bills that everybody knew would cause inflation. As if on cue, after acknowledging that “he gets it” on the stresses of inflation on the American people, he attempts to defend continuing on his disastrous path by noting that leading Nobel Laureate economists claimed that his policies will strengthen the economy for everyone. He does not seem to see the cause and effect principles that govern reality.

He also repeated his ignorance that his policies created over 6 million new jobs last year. We have addressed this in previous posts, but it bears repeating. Those jobs were coming back once the economy reopened. There is NO policy which this administration has implemented that can be attributed to creating any NEW jobs.

 

COVID

If we were a cynical and conspiratorial organization, we might find merit in the belief there has been some shenanigans going on with mask mandates. We find it wildly convienient, from a political perspective, that Nancy Pelosi lifted mask mandates for the US Capitol the morning of the SOTU speech. Did she have access to secret science information which allowed her to take such action?

Here again, there is no policy Biden has had that brought us through the pandemic.

In perhaps one of the more egregious examples of whiplash, Biden pleaded for America to stop making COVID a political issue. This from the man who claimed Republican governors were creating ‘states of death’, who told the American people his patience was running out with people who were unvaccinated. We wonder who made it political. Bidens said that Trump did not deserve the presidency given the number of people who died on his watch. That number is far greater under Bidens inaction, yet we heard no word of his resignation.

 

CRIME

It is a matter of record that the policies of the political left are the foundation of the increase in criminal activity in our largest cities. In what struck  us as the single most disgusting moment of his speech, no sooner had he mentioned the ambush and murders of Officer Jason Rivera and Officer Wilbert Mora, than he called out for police accountability. In a moment of profound absurdity, he stressed his desire to FUND the police, not DEFUND them.

Apparently no one in the White House communications office has ever heard of Google or YouTube. A simple search will provide you with endless clips of Biden agreeing that cutting funding to police departments was a good idea during the summer 2020 riots.

 

IMMIGRATION & THE OPIOID CRISIS

President Trump instituted the ‘remain in Mexico’ policy, ended ‘catch and release’  and began construction of a security wall along our southern border. His policies worked, dropping illegal immigration to historic low levels. Biden, in his hate-filled disgust of all things Trump, cancelled all of those policies that again, were working. He appointed a border czar in Vice-President Harris, who, in more than a year, has never visited the border. Biden then has the arrogance to demand the Congress “fix our immigration laws”.

He has yet to enforce the existing laws, so what exactly does he want fixed?

Aside from the human suffering instituted as policy by Biden, he has ignored the opiod crisis flowing across that same border. In his declaration that we must stop the overdose epidemic of fentanyl, he forgoes acknowledging the source of that drug: China.

Americans can understand a weak leader, but they will not accept an inept one.

 

We believe it unconscionable that the President of the United States would be so blatant and exquisite a liar.

2-13-22. Guest Commentary - "Turn The Spigots Back On"

It would be difficult to argue that there is any manner of success for the American people during the first year of the Biden administration. In an effort to appease the radical political left, Biden has undone all of the successful policies of the Trump years. Elections are about making choices, and with his election, Biden has the authority to dismantle success and tank the American economy and our position of strength on the world stage.

After demonstrating cowardice with his running scared exit from Afghanistan, he signaled to the world and our adversaries in particular that America had transitioned to being a feckless power.

In an attempt to provide a solution to the American people and guidance to a man in mental decline, consider how quickly Biden can reverse America’s fortunes. All he needs to do is to turn the spigot back on for the domestic energy supply.

Remember that on day one of his presidency, Biden cancelled the XL pipeline, and cancelled all federal leases for drilling oil and natural gas. Only seconds before taking those imbecilic actions, America was energy independent and a net exporter of energy. This meant we did not need to engage with nations anywhere on the planet to provide us with oil or natural gas. Experts had determined we had sufficient untapped resources  in this country to support our energy requirements for at lease 100 years. As soon as Biden opted out of that status, it became necessary for him to go hat in hand to ask oil producing nations to increase their production. Given that increasing production would drive down the price, and profits, Biden seemed stunned his requests were ignored. He then released stores of our nations national reserve in hopes of driving down the price. It worked. A gallon  of gas dropped 12 cents for about two weeks. Leadership incarnate.

Biden then gave approval for Russia to to continue building THEIR pipeline to Europe, removing Trump’s sanctions to the contrary.

It was, and is, an absolutely stunningly stupid decision.

After Biden exited from Afghanistan, and turning over control of our energy to Russia, Biden now sees himself on the precipice of a disaster with Ukraine. He has promised ‘tough sanctions’ if Russia invades Ukraine. This policy mirrors the Obama administration’s position on Crimea. That has failed and Crimea is now under Russian control.

Only an idiot would choose to repeat a catastrophic failure.

People are calling for sanctions now, which Biden has resisted.

Here is how turning on the flow of domestic energy solves everything.

Inflation has hit a 40 year high under Joe, driven in large part due to energy costs. Returning to energy independence goes a long way to easing inflation and returning America to prosperity. Turning the spigot back on also helps crash Russia’s economy. Fifty percent of their economy is sustained by selling energy. If we return to exporting energy, not only do we cut our dependence to Russian energy, we can provide a more stable source to many of Russia’s clientele. We accomplish more by being independent than by just hoping new sanctions work. To help assure the collapse of Russia’s threats to Ukraine, we should reimpose the sanctions on the Russian pipeline to Europe. It is difficult to sustain an army without the ability to support it financially.

Biden can solve our energy, inflation and Ukraine concerns with a simple decision. Turn the spigot back on.

There are of course those on the political left who will try to prevent Biden from diverting from his oil-free climate change agenda.

Rather than destroying the American economy in pursuit of such an elusive concept, we propose a simple solution.

Use the American economy and capitalism to address the issue.

Consider this proposal.

We will call it the “America For The World Plan”:

What left leaning progressive could deny the title?

Biden could propose  that the first company which creates a renewable energy source to replace fossil fuels and designs a viable delivery system would become a tax-free company. They would pay no taxes for fifty years. They would sell their patent to the American people for one dollar, and receive a percentage from every use of the patent.

It would work much faster than edicts, mandates, insipid laws and tern loose the economic power of America.

All Biden has to do is to turn the spigots back on.

American Perspective (part three) We The People

In parts one and two, our intent was to buttress our argument that President Biden and his cronies, flacks and the extreme members of the far left do not have even a basic, fundamental understanding of the United States Constitution. There is no tone of gravitas or repeated claims that will ever support their attempts to ignore the  inconvenient realities of limited government as detailed in our governing document. The blatant assault on liberty is encased in Biden’s rhetoric that parts of the Constitution are “not absolute”. Yes, we do have a fixation in our repeated reminders with regard to the statement. As previously noted, being selective in the rights of Americans would create a nation in which chanting “Let’s Go Brandon”, and our new favorite “Let’s Go Brenda”, could be a crime with accompanying penalties. That would not be the nation envisioned by our founders and framers. It would not be the nation remembered just 10 years ago by those today.

Covid-19 brought much of how government works to the forefront of politics, and where it has lost its way. Mostly how it has lost its way.

The pandemic, we were told, required a two to three-week shutdown of the nation in order to, as it was said “flatten the curve”. In other words, we accepted that doing what we could to help alleviate the impending strain on hospitals, which would be a national health emergency, was the thing to do. All the experts said so. America is nothing if not patriotic and generous, so we did as we were asked.

And then something happened in governments across the land. People of no consequence, who had never amounted to much, grabbed their reins of power and became intoxicated with the sense that their word was law. Mandates began flying, and the stenographic sycophantic mass media began parroting the same lies.

The sad tale of Covid is not our focus in this discussion. The ever-steady encroachment of totalitarianism and the continual erosion of our rights is the topic.

Consider that with very few exceptions, political leaders have made the comment that their intention was to return the rights back to their citizens as quickly as possible.

The rights were not theirs to take, thus they could not be able to return what was not theirs. When pressed on the point about by what authority did he limit those rights, New Jersey Governor Phil Murphy quipped that consulting the United States Constitution was “above my pay grade”.

Therein lies the problem, and why The Madison Conservative constantly stresses the supremacy of the Constitution in matter of public policy.

The American people are as a whole a law-abiding society. They understand that if a law is passed, after rigorous debate from all sides, it is in fact the law and must be obeyed.

Every American will also most certainly chafe at mandates, those edicts handed down by would-be tyrants, regardless of their position. If they believe they have the power, they will use it. They see every issue as a nail and themselves as the hammer.

This is NOT America.

What then should society do to combat this nemesis? We would ask you to familiarize yourself with the Constitution, amendments and all.

When you hear your neighbors make comments in the extreme, there is no need to proselytize.

Try something subtler.

To wit:

“Man, why doesn’t Biden just mandate that everybody follow his mandates?”

Respond with…

“Yeah, but that pesky 10th amendment forbids him from doing so and leaves it to the states. Gotta play by the rules, I guess.”

The conversation might go this way.

“ I saw some idiot on TV last night talking about everything that’s wrong with America. If they don’t like it, tell them to get out.”

And your response…

“Yeah, but the first amendment protects all speech, especially the speech you hate the most. Remember, America, land of the free, for you and for me.”

There are an infinite variations of course, but the conversations must be had. The facts are on the side of those who know the Constitution.

Americans created it, and Americans must defend it.
